What is an LPA?

LPA’s allow you to appoint someone you trust to manage your affairs should you lack the mental or physical capacity to do so. This person is known as your Attorney.

There are two types of LPA’s:

  • Property and Financial – Gives your appointed attorney(s) the authority to access and manage your financial and property affairs.
  • Health and Welfare – Allows your appointed attorney(s) to make decisions about your wellbeing, medical care, moving into a care home, and life sustaining treatment. It can only be used if you are unable to make your own decisions.

Your Attorney’s will need to be people you trust to act on your behalf, and with your best interests in mind.

LPA’s for Personal Pension customers are critical!

If you were to lose capacity without having Lasting Power of Attorney (LPA’s) in place, a family member would need to apply to the Court of Protection for Deputyship, in order to manage your affairs.

The costs involved are significantly more than having the LPA’s set up and also include additional ongoing costs:

  • The cost per application is £365, therefore if you require both Property & Finance and Health & Welfare the fee payable to the Court of Protection for Deputyship will be £730.
  • If the court decides a hearing is needed there is an additional fee of £100.
  • There is a yearly fee of up to £320 depending on the value of the estate and an assessment fee of £100.

This process is incredibly time consuming and can cause a great deal of additional stress at an already difficult time. Without Deputyship, your loved ones would not be able to access your pension funds or make decisions on your behalf.
