LPA’s allow you to appoint someone you trust to manage your affairs should you lack the mental or physical capacity to do so. This person is known as your Attorney.
There are two types of LPA’s:
Your Attorney’s will need to be people you trust to act on your behalf, and with your best interests in mind.
If you were to lose capacity without having Lasting Power of Attorney (LPA’s) in place, a family member would need to apply to the Court of Protection for Deputyship, in order to manage your affairs.
The costs involved are significantly more than having the LPA’s set up and also include additional ongoing costs:
